JOHOR BAHRU: Three men were acquitted by a High Court here of the murder of a four-year-old girl in 2001, and were charged with robbery instead.
Justice Syed Ahmad Helmy Shed Ahmad acquitted the accused – Muthu Vellu, 32, Ng Terk Chai, 32, and Goh Wee Kok, 34, – saying there was a loophole in the prosecution’s case.
Justice Syed Ahmad then added that all three accused would instead be charged under Section 392/397 of the Penal Code for robbery.
“It is a shame that there was a loophole in the prosecution’s case.
“What you have done, however, will not be forgiven by the victim’s family as you will never be able to return their daughter to them,” he said.
He added that the case had also become public concern and involved the loss of a life, before he passed sentence.
“I am hereby sentencing all three of you to the maximum sentence of 10 years’ imprisonment and three strokes of the cane each,” he said, adding that the sentence should be served from Aug 21.
All three accused were initially charged with the murder of the four-year-old girl on Aug 17, 2001, at Jalan Johor in Pontian here.
Deputy Public Prosecutor Azreen Yas Mohamad Ramli prosecuted the case while lawyers Hisyam Teh Poh Teh and Bernard George represented the accused.
